Estates are set up to arrange for the management and distribution of assets for those who have passed. An effective plan may keep your estate out of Probate Court entirely and leave more benefits for the beneficiaries. Documents for an effective estate plan may include Wills, Trusts, Special Needs Trusts, Durable Powers of Attorney, Durable Special Powers of Attorney, and Advanced Directives for Healthcare.
Probate is a legal process which validates a Will then directs the process of distribution of an estate under the terms of that Will. A Will which is not proved valid or if a Will does not exist, the Probate process distributes the estate under Oklahoma Intestacy laws. Probate can take a long time to finalize which may become costly over time.
Purchase or sale of a home or property or acquisition of oil, gas and other mineral interests will often include the need to sign deeds, check the title of the property, or review documents required to receive royalty interests or payments for pipeline easement(s) and right-of-way. Each type of transaction requires a specific type of instrument to affect the lease, sale or purchase of the property and the utility or mineral rights involved. Checking the chain of title or history of prior transactions that are filed of record is required by lending institutions in order to secure a mortgage on a purchase.
